La judicialización de la política argentina abre un hiato entre el creciente activismo en materia política desarrollado por los tribunales de justicia y la tradicional legitimidad atribuida al judicial en tanto que poder conservador de la constitución. Este déficit de legitimidad del poder judicial ha intentado subsanarse mediante el recurso a instancias participativas, inspiradas en el modelo de la democracia deliberativa. Esto ha dado lugar a una serie de innovaciones institucionales en la corte suprema argentina, como la admisión de amigos (...) del tribunal y la celebración de audiencias públicas. La evaluación de estas experiencias permite, sin embargo, identificar una concepción de la participación ciudadana que apunta a la intervención de especialistas y que privilegia la intermediación de abogados y juristas. The judicialization of Argentine politics opens a gap between the activism in political matters developed by the judges and the legitimacy traditionally attributed to the judiciary, as the power in charge of the conservation of the constitution. Recent efforts to supersede this deficit in terms of legitimacy pointed to participatory processes, inspired by the model of deliberative democracy. In this sense, the Argentine supreme court has developed a series of institutional innovations, such as the admission of amici curiae and the holding of public hearings. The evaluation of these experiences allows nonetheless to identify an underlying conception of citizen participation focused on the intervention of specialists and the intermediation of lawyers and legal scholars. Las primeras elaboraciones sistemáticas sobre la obligación estatal parten de la identificación de la voluntad y los derechos del individuo como fuente de legitimación de todo orden. Este artículo ofrece una mirada panorámica e introductoria a las contribuciones señeras del moderno derecho natural, al tiempo que problematiza el lugar que estas teorías asignan a las mujeres y a los no europeos.

En 1964, en una entrevista televisiva a Günter Gaus, Hannah Arendt explicaba que la teoría política era un género del pensamiento en sí mismo: ni una filosofía política, ni una ciencia social empírica. Así, se abría un campo de estudios al mismo tiempo que se desdibujaba su especificidad metodológica. Métodos de teoría política: un manual se hace cargo de esa vacancia y nos presenta un vasto inventario de posibles metodologías a aplicar en el área de teoría política. A lo largo (...) de sus capítulos recorre no una sino ocho estrategias posibles: historia de las ideas, historia intelectual, historia conceptual, hermenéutica, comprensión del acontecimiento, deconstrucción, arqueología/genealogía y teoría crítica. Ahora bien, lo interesante de esta propuesta es que, además de saldar una deuda para con la disciplina, evita cualquier carácter prescriptivo: si lo político se trata justamente de algo inclausurable, plural, no es posible hablar de un método correcto o auténtico. Artificial agents (AAs), particularly but not only those in Cyberspace, extend the class of entities that can be involved in moral situations. For they can be conceived of as moral patients (as entities that can be acted upon for good or evil) and also as moral agents (as entities that can perform actions, again for good or evil). In this paper, we clarify the concept of agent and go on to separate the concerns of morality and responsibility of agents (most (...) interestingly for us, of AAs). We conclude that there is substantial and important scope, particularly in Computer Ethics, for the concept of moral agent not necessarily exhibiting free will, mental states or responsibility. This complements the more traditional approach, common at least since Montaigne and Descartes, which considers whether or not (artificial) agents have mental states, feelings, emotions and so on. By focussing directly on mind-less morality we are able to avoid that question and also many of the concerns of Artificial Intelligence. A vital component in our approach is the Method of Abstraction for analysing the level of abstraction (LoA) at which an agent is considered to act. The LoA is determined by the way in which one chooses to describe, analyse and discuss a system and its context. The Method of Abstraction is explained in terms of an interface or set of features or observables at a given LoA. Agenthood, and in particular moral agenthood, depends on a LoA. Our guidelines for agenthood are: interactivity (response to stimulus by change of state), autonomy (ability to change state without stimulus) and adaptability (ability to change the transition rules by which state is changed) at a given LoA. Morality may be thought of as a threshold defined on the observables in the interface determining the LoA under consideration. An agent is morally good if its actions all respect that threshold; and it is morally evil if some action violates it. That view is particularly informative when the agent constitutes a software or digital system, and the observables are numerical. Finally we review the consequences for Computer Ethics of our approach. In conclusion, this approach facilitates the discussion of the morality of agents not only in Cyberspace but also in the biosphere, where animals can be considered moral agents without their having to display free will, emotions or mental states, and in social contexts, where systems like organizations can play the role of moral agents. The primary cost of this facility is the extension of the class of agents and moral agents to embrace AAs. (shrink)

The essential difficulty about Computer Ethics' (CE) philosophical status is a methodological problem: standard ethical theories cannot easily be adapted to deal with CE-problems, which appear to strain their conceptual resources, and CE requires a conceptual foundation as an ethical theory. Information Ethics (IE), the philosophical foundational counterpart of CE, can be seen as a particular case of environmental ethics or ethics of the infosphere. What is good for an information entity and the infosphere in general? This is the ethical (...) question asked by IE. The answer is provided by a minimalist theory of deseerts: IE argues that there is something more elementary and fundamental than life and pain, namely being, understood as information, and entropy, and that any information entity is to be recognised as the centre of a minimal moral claim, which deserves recognition and should help to regulate the implementation of any information process involving it. IE can provide a valuable perspective from which to approach, with insight and adequate discernment, not only moral problems in CE, but also the whole range of conceptual and moral phenomena that form the ethical discourse. I love information upon all subjects that come in my way, and especially upon those that are most important. Thus boldly declares Euphranor, one of the defenders of Christian faith in Berkley’s Alciphron (Berkeley, (1732), Dialogue 1, Section 5, Paragraph 6/10). Evidently, information has been an object of philosophical desire for some time, well before the computer revolution, Internet or the dotcompandemonium (see for example Dunn (2001) and Adams (2003)). Yet what does Euphranor love, exactly? What is information? The question (...) has received many answers in different fields. Unsurprisingly, several surveys do not even converge on a single, unified definition of information (see for example Braman 1989, Losee (1997), Machlup and Mansfield (1983), Debons and Cameron (1975), Larson and Debons (1983)). This paper outlines a quantitative theory of strongly semantic information (TSSI) based on truth-values rather than probability distributions. The main hypothesis supported in the paper is that the classic quantitative theory of weakly semantic information (TWSI), based on probability distributions, assumes that truth-values supervene on factual semantic information, yet this principle is too weak and generates a well-known semantic paradox, whereas TSSI, according to which factual semantic information encapsulates truth, can avoid the paradox and is more in line with the (...) standard conception of what generally counts as semantic information. After a brief introduction, section two outlines the semantic paradox implied by TWSI, analysing it in terms of an initial conflict between two requisites of a quantitative theory of semantic information. In section three, three criteria of semantic information equivalence are used to provide a taxonomy of quantitative approaches to semantic information and introduce TSSI. In section four, some further desiderata that should be fulfilled by a quantitative TSSI are explained. From section five to section seven, TSSI is developed on the basis of a calculus of truth-values and semantic discrepancy with respect to a given situation. In section eight, it is shown how TSSI succeeds in solving the paradox. Section nine summarises the main results of the paper and indicates some future developments. (shrink)

In 2016, the European Parliament approved the General Data Protection Regulation (GDPR) whose core aim is the safeguarding of information privacy, and, by corollary, human dignity. Drawing on the field of philosophical anthropology, this paper analyses various interpretations of human dignity and human exceptionalism. It concludes that privacy is essential for humans to flourish and enable individuals to build a sense of self and the world.

Scholars and policy makers often refer to the “information society”. And yet, it is more accurate to speak of societies, each different, some of which may qualify as information ones at different levels of maturity. Through exploration of the concepts of expectations, education and innovation, this paper explores what it means for an information society to be more or less mature than others, and the impact of this on the ongoing digital revolution.

This chapter addresses two questions. First, if knowledge is accounted information, how are we supposed (to apply this analysis in order) to understand perceptual knowledge and knowledge by testimony? In the first part of the chapter, I articulate an answer in terms of a re-interpretation of perception and testimony as data providers rather than full-blown cases of knowledge. Second, if perception and testimony are correctly understood as data providers, how are we supposed (to apply this analysis in order) to understand (...) the semantic value of the data provided by such processes? In the second part of the chapter, I argue in favour of a constructionist hypothesis about how data may become meaningful for human cognitive agents through a process of repurposing of natural data/signals. In previous works, I defined ourselves as informational organisms, or inforgs for short, who forage for, produce, cultivate, curate, process, and consume information (Floridi 2013). Yet, we may also be understood as interfaces, who inhabit and interact with, an environment also made up of data and computational processes. By describing ourselves in such terms, this paper argues that we can better understand several crucial phenomena that characterise our digital age, including marketing and the “marketisation” of political communication. The European Medical Information Framework project, funded through the IMI programme, has designed and implemented a federated platform to connect health data from a variety of sources across Europe, to facilitate large scale clinical and life sciences research. It enables approved users to analyse securely multiple, diverse, data via a single portal, thereby mediating research opportunities across a large quantity of research data. EMIF developed a code of practice to ensure the privacy protection of data subjects, protect the interests of (...) data sharing parties, comply with legislation and various organisational policies on data protection, uphold best practices in the protection of personal privacy and information governance, and eventually promote these best practices more widely. EMIF convened an Ethics Advisory Board, to provide feedback on its approach, platform, and the EcoP. The most important challenges the ECoP team faced were: how to define, control and monitor the purposes for which federated health data are used; the kinds of organisation that should be permitted to conduct permitted research; and how to monitor this. This manuscript explores those issues, offering the combined insights of the EAB and EMIF core ECoP team. For some issues, a consensus on how to approach them is proposed. For other issues, a singular approach may be premature but the challenges are summarised to help the community to debate the topic further. Arguably, the issues and their analyses have application beyond EMIF, to many research infrastructures connected to health data sources. (shrink)

The use of "levels of abstraction" in philosophical analysis (levellism) has recently come under attack. In this paper, we argue that a refined version of epistemological levellism should be retained as a fundamental method, which we call the method of abstraction. After a brief introduction, in section two we make clear the nature and applicability of the (epistemological) method of levels of abstraction. In section three, we show the fruitfulness of the new method by applying it to five case studies: (...) the concept of agenthood, the Turing test, the definition of emergence, quantum observation and decidable observation. In section four, we further characterise and support the method by distinguishing it from three other forms of "levellism": (i) levels of organisation; (ii) levels of explanation and (iii) conceptual schemes. In this context, we also briefly address the problems of relativism and antirealism. In the conclusion, we indicate some of the work that lies ahead, two potential limitations of the method and some results that have already been obtained by applying the method to some long-standing philosophical problems. In this opening chapter, we review the literature on information quality. Our major aim is to introduce the issues, and trace some of the history of the debates, with a view to situating the chapters in this volume – whose authors come from different disciplines – to help make them accessible to readers with different backgrounds and expertise. We begin in this section by tracing some influential analyses of IQ in computer science. This is a useful basis for examining some (...) examples of developing work on IQ in section two. After the introduction, in section two, semantic information is shown to be translatable into propositional semantic information (i). In section three, i is polarised into a query (Q) and a result (R), qualified by a specific context, a level of abstraction and a purpose. This polarization is normalised in section four, where [Q + R] is transformed into a Boolean question and its relative yes/no answer [Q + A]. (...) In sections five and six, it is argued that (1) A is the correct answer to Q if and only if (2) A correctly saturates (in a Fregean sense) Q by verifying and validating it (in the computer science’s sense of “verification” and “validation”); that (2) is the case if and only if (3) [Q + A] generates an adequate model (m) of the relevant system (s) identified by Q; that (3) is the case if and only if (4) m is a proxy of s (in the computer science’s sense of “proxy”) and (5) proximal access to m commutes with the distal access to s (in the category theory’s sense of “commutation”); and that (5) is the case if and only if (6) reading/writing (accessing, in the computer science’s technical sense of the term) m enables one to read/write (access) s. We know very little about mathematical skepticism in modem times. Imre Lakatos once remarked that “in discussing modem efforts to establish foundations for mathematical knowledge one tends to forget that these are but a chapter in the great effort to overcome skepticism by establishing foundations for knowledge in general." And in a sense he was clearly right: modem thought — with its new discoveries in mathematical sciences, the mathematization of physics, the spreading of Pyrrhonist doctrines, the centrality of epistemological foundationalism (...) and the diffusion of the geometrical method in philosophy — was the most natural arena in which skepticism and mathematics could confront each other. The problem remains, however, that no investigation of the whole topic has yet been attempted. Thus, as far as we know, mathematical certainties should have clashed with skeptical doubts, but whether and to what extent there was indeed a historical debate on mathematical skepticism in modern thought remains to be ascertained. Altruism is a well-studied phenomenon in the social sciences, but online altruism has received relatively little attention. In this article, we examine several cases of online altruism, and analyse the key characteristics of the phenomenon, in particular comparing and contrasting it against models of traditional donor behaviour. We suggest a novel definition of online altruism, and provide an in-depth, mixed-method study of a significant case, represented by the r/Assistance subreddit. We argue that online altruism can be characterized by its differing (...) experiences compared to traditional giving, from a giver’s point of view, and unique mechanisms and actions made possible by the internet. These findings explain why people give to anonymous strangers online and provide a new perspective on altruism that is important in building a more altruistic internet and society. (shrink)

Library information science (LIS) should develop its foundation in terms of a philosophy of information (PI). This seems a rather harmless suggestion. In Floridi (2002a), I have articulated some of the reasons why I believe that PI can fulfill the foundationalist needs better than SE can. In this contribution, I clarify some aspects of my proposal (Floridi, 2002a) in favor of the interpretation of LIS as applied PI. The aim of the article is to remove some ambiguities and possible misunderstandings (...) that might prevent the correct evaluation of my position, so that disagreement can become more constructive. In this paper, I first outline a model of Computer-Meditated Interaction (CMI) to distinguish between (1) CMI HCI-transparent (HCI = human-computer interaction) and (2) CMI HCI-dependent. Some main features of (1) are then analysed (data-radiation, data-tracking, internalisation of problem solving), while (2) is further divided into (2.1) CMI-HCI stand-alone and (2.2) CMI-HCI on-line. Some advantages and limits of (2.1) are suggested, together with an overview of the present and future strategies leading the production of new applications in the field. The (...) analysis of (2.2) provides a last distinction between communication-oriented and elaboration-oriented CMI-HCI on-line (i.e. CMC and NIA). A description of these two forms of CMI is then sketched, together with an interpretation of the new strategic view which should lead the projection of applications in the field, a possible agenda and a forecast of the chief effects of some present trends. Mark Greenberg argues that legal obligations are those moral obligations created by the actions of legal institutions in the legally proper way. Here I defend three main claims. First, I argue that, although very often misunderstood, Joseph Raz is also a defender of MITL. Secondly, I argue that while both Greenberg and Raz are committed to MITL, they disagree about the conditions under which a moral obligation can be said to be created in the legally proper way. Finally, I argue (...) that Raz’s variant of MITL is better than Greenberg’s. It rests on a more plausible account of authority and it avoids one of the crucial defects threatening Greenberg’s view, namely, its overinclusiveness. (shrink)

What is the primary function of consciousness in the nervous system? The answer to this question remains enigmatic, not so much because of a lack of relevant data, but because of the lack of a conceptual framework with which to interpret the data. To this end, we have developed Passive Frame Theory, an internally coherent framework that, from an action-based perspective, synthesizes empirically supported hypotheses from diverse fields of investigation. The theory proposes that the primary function of consciousness is well-circumscribed, (...) serving the 'somatic nervous system[. For this system, consciousness serves as a frame that constrains and directs skeletal muscle output, thereby yielding adaptive behavior. The mechanism by which consciousness achieves this is more counterintuitive, passive, and “low level” than the kinds of functions that theorists have previously attributed to consciousness. Passive frame theory begins to illuminate (a) what consciousness contributes to nervous function, (b) how consciousness achieves this function, and (c) the neuroanatomical substrates of conscious processes. Our untraditional, action-based perspective focuses on olfaction instead of on vision and is 'descriptive' (describing the products of nature as they evolved to be) rather than 'normative' (construing processes in terms of how they should function). Passive frame theory begins to isolate the neuroanatomical, cognitive-mechanistic, and representational (e.g., conscious contents) processes associated with consciousness. (shrink)

Toleration is one of the fundamental principles that inform the design of a democratic and liberal society. Unfortunately, its adoption seems inconsistent with the adoption of paternalistically benevolent policies, which represent a valuable mechanism to improve individuals’ well-being. In this paper, I refer to this tension as the dilemma of toleration. The dilemma is not new. It arises when an agent A would like to be tolerant and respectful towards another agent B’s choices but, at the same time, A is (...) altruistically concerned that a particular course of action would harm, or at least not improve, B’s well-being, so A would also like to be helpful and seeks to ensure that B does not pursue such course of action, for B’s sake and even against B’s consent. In the article, I clarify the specific nature of the dilemma and show that several forms of paternalism, including those based on ethics by design and structural nudging, may not be suitable to resolve it. I then argue that one form of paternalism, based on pro-ethical design, can be compatible with toleration and hence with the respect for B’s choices, by operating only at the informational and not at the structural level of a choice architecture. This provides a successful resolution of the dilemma, showing that tolerant paternalism is not an oxymoron but a viable approach to the design of a democratic and liberal society. (shrink)

The digital is deeply transforming reality. Through discussion of concepts such as identity, location, presence, law and territoriality, this article explores why and how these transformations are occurring, and highlights the importance of having a design and a plan for our new digital world.

By promising, requesting and commanding we can give ourselves and each other reasons for acting as promised, requested, and commanded. Call this our capacity to give reasons robustly. According to the triggering account, we give reasons robustly simply by manipulating the factual circumstances in a way that triggers pre-existing reasons. Here I claim that we ought to reject the triggering account. By focusing on David Enoch’s sophisticated articulation of it, I argue that it is overinclusive; it cannot adequately distinguish between (...) threats and robust reason-giving; and it cannot adequately explain why epistemic reasons cannot be robustly given. I suggest that when we give reasons robustly, we do so directly, without explanatory intermediaries. (shrink)

Por un lado, permite reconstruir los momentos esenciales de su crítica a la filosofía del sujeto. Pero la crítica moral también ofrece la posibilidad de realizar una indagación más formal de su obra, dado que la misma figura como uno de los objetos privilegiados de la Dialéctica Negativa. De este modo, al revisar su crítica moral uno tiene la oportunidad de plantear la difícil pregunta por (...) la forma de esa filosofía que se presenta a sí misma como una dialéctica que exacerba la negatividad del pensamiento. Se suele plantear que a comienzos del siglo XX las investigaciones acerca del control social abandonan la prisión como tema central para pensar el problema del orden a partir de la ciudad. Sin embargo, poco se ha dicho de la conexión, a veces subterránea, que ello guarda con la obra de Franz Kafka. Consideramos posible rastrear en la literatura del autor checo el proceso por el cual la ciudad va convirtiéndose en un eje en el cual se desarrollan un sinnúmero (...) de sucesos, justamente cuando en la Escuela de Chicago comenzaban a elaborarse las bases para una teoría ecológica de la organización social. El siguiente trabajo se propone Hamar la atención sobre algunos pasajes de los Dialogos platónicos con el fin de poder extraer de su analisis algunas consideraciones respecto de la noción de logos en relación con la figura del filósofo. Para esto, dividire la exposición segun los siguientes puntos: (I) para constituir una base de apoyo hermeneutico adecuada, recordare primero la naturaleza de la tekhne eidolopoiike tal como es presentada en el Sofista (235d y ss.); luego (II) sefialare la importancia de (...) ciertos pasajes de los Dialogos medios que se refieren a la limitación y función intrinseca del logos ante la captación del ser verdadero; y por ultimo, (III) dare un ejemplo de la superación filosofica del logos teniendo en cuenta lo encontrado en II. En este trabajo, analizo críticamente la tesis de Nino según la cual el valor epistémico de la democracia soluciona la paradoja de la superfluidad del derecho. En este sentido, examino dos cuestiones. Primero, si el valor epistémico de la democracia es una razón para creer que tenemos razones para actuar de conformidad con las leyes democráticas. Segundo, si el valor epistémico de la democracia es una razón para actuar de conformidad con las leyes democráticas independientemente de los méritos del caso (...) y, en su caso, si ello explica adecuadamente la normatividad del derecho. In this paper I critically analyse Nino’s thesis according to which the epistemic value of democracy solves the paradox of the superfluousness of law. In this regard, I address two issues. First, if the epistemic value of democracy is a reason to believe that we have reasons to act in conformity with democratic laws. Second, if the epistemic value of democracy is a reason to act in conformity with democratic laws independently of the merits of the case and, in that case, if that can adequately explain the normativity of law. August Ludwig Hülsen’s virtually forgotten “Prüfung der von der Akademie der Wissenschaften zu Berlin aufgestellten Preisfrage: Was hat die Metaphysik seit Leibniz und Wolf für Progressen gemacht?” is the first German post-Kantian system in which reason is conceived as developing in history according to speculative rule based on the logical resolving of contradictions. Notwithstanding, Hülsen’s system is up to this day almost entirely unknown to most scholars in the field. This paper outlines the fundamental aspects of Hülsen’s system and discusses (...) two of its main innovations: the deduction of the transcendental possibility of rational historicity, and the systematic historization of Fichte’s concept of judging activity; the constitutive equivalent of consciousness’s logical-temporal substrate. I argue in this paper that Descartes is committed both to a compatibilist view concerning the relation between free will and divine preordination, namely, one according to which both of these views come out true, and to a libertarian view as regards human free will. I defend here that what allows our author to maintain both of these committments is what I call Mysterism, namely, the view according to which God's immense and incomprehensible nature explains our incapacity to understand fully (...) that compatibility through our own finite reason. Can knowledge provide its own justification? This sceptical challenge - known as the problem of the criterion - is one of the major issues in the history of epistemology, and this volume provides its first comprehensive study, in a span of time that goes from Sextus Empiricus to Quine. After an essential introduction to the notions of knowledge and of philosophy of knowledge, the book provides a detailed reconstruction of the history of the problem. There follows a conceptual analysis of (...) its logical features, and a comparative examination of a phenomenology of solutions that have been suggested in the course of the history of philosophy in order to overcome it, from Descartes to Popper. In this context, an indirect approach to the problem of the criterion is defended as the most successful strategy against the sceptical challenge. (shrink)
